ATTENTION: Unfold Your Best ("Unfold Your Best") is responsible for operating this website, as well as other health, wellness, diet, and physical activity web pages that are part of the Unfold Your Best portal network (collectively referred to as "Portals") and for the related services or those made available on these Portals (hereinafter, the "Services"). Certain Portals are operated by us on behalf of third-party licensors (collectively, "Licensors"; such Licensors, together with Unfold Your Best, are referred to as "we"). The Services offered by Unfold Your Best may encompass, without limitation, tools, applications, email services, bulletin boards and messages, chat rooms, newsgroups, forums, communities, calendars, and downloadable mobile applications related to or provided through the Portals. The operation of the Portals and Services is funded, and Unfold Your Best generates revenue, through advertising, sponsored content, affiliate program commissions, lead generation, and other sources. This Terms of Use Agreement ("TOU") establishes the rules for your use of any Portals and Services provided by Unfold Your Best. It is essential that you read this agreement carefully before starting to use any Portal or Service. By accessing or using the Portals or Services, you expressly agree to be bound by the terms described herein. If you do not agree to all provisions of this TOU, you are not authorized to access or use the Portals or Services. Additionally, some specific sections of the Portals or Services may be subject to additional terms of use that we make available for review. By using those areas, you explicitly affirm that you have read and agree to be bound by the applicable additional terms. In case of discrepancy between the additional terms of a specific area and this TOU, the additional terms will prevail.

THIS AGREEMENT INCLUDES A MANDATORY ARBITRATION CLAUSE AND A WAIVER OF CLASS ACTIONS.

1. The information on this portal is for informational purposes only and does not substitute for any kind of medical guidance.
The Portals and Services provide content related to health, fitness, and nutrition, intended solely for informational and non-commercial purposes. YOU MUST NOT USE THIS INFORMATION AS A SUBSTITUTE FOR, AND IT DOES NOT REPLACE, PROFESSIONAL MEDICAL DIAGNOSIS, TREATMENT, OR ADVICE FROM A PHYSICIAN. IF YOU HAVE ANY QUESTION OR CONCERN ABOUT YOUR HEALTH OR THE CONTENT OF THE PORTALS OR SERVICES, YOU MUST ALWAYS CONSULT A PHYSICIAN OR OTHER QUALIFIED HEALTHCARE PROFESSIONAL. DO NOT IGNORE, DELAY, OR AVOID SEEKING MEDICAL OR HEALTH-RELATED GUIDANCE BECAUSE OF SOMETHING YOU HAVE READ ON A PORTAL OR THROUGH THE SERVICES. THE USE OF ANY INFORMATION OBTAINED ON THE PORTALS OR THROUGH THE SERVICES IS AT YOUR SOLE RISK. Nothing stated or published on the Portals or made available through any Service should be construed as, or is intended to constitute, the practice of medicine or medical advice. For the purposes of this agreement, the practice of medicine and advice includes, without limitation, psychiatry, psychology, psychotherapy, pharmaceutical practice, nutritional or fitness counseling, or the provision of any treatment, instructions, diagnosis, prognosis, or advice in the health domain. Progress in medical research may influence the health, fitness, and nutrition topics discussed on the Portals or Services, and there is no guarantee that the information presented always reflects the latest findings or developments on a given subject. Your access or use of the Portals and Services does not create, under any circumstances, a doctor-patient, confidential, privileged, or any other relationship that implies obligations on our part or on the part of our Licensors. We do not recommend or endorse any specific test, physician, clinic, procedure, opinion, product, or other information that may appear on the Portals or Services. If you rely on any information provided through these Portals or Services, be it from our employees, guests, or other visitors, you do so at your own risk.

2. User Responsibilities.
You agree to comply with all applicable local, state, national, and international laws and regulations, including U.S. or other Country export control, re-export, and economic sanctions laws, regarding your use of the Portals and Services. You also acknowledge that the use of the Internet and access to the Portals is entirely your responsibility. You must also understand that we cannot guarantee the confidentiality of any communication or material transmitted to/from a Portal over the Internet or other global communication network. Therefore, Unfold Your Best is not responsible for the security of any information transmitted to or from the Portals. Unfold Your Best reserves the right to prohibit or terminate your use or access to the Portals at any time, without prior notice and for any reason.

3. License to Use.
This TOU grants you a personal, revocable, limited, non-exclusive, royalty-free, and non-transferable license to use the Portals, conditioned on your continued compliance with these terms. You may print and download materials and information from the Portals only for your personal use, provided all copies include in full the copyright notices and other relevant notices contained therein.

4. Prohibited Conduct.
The Portals and Services are not intended for minors under the age of 18 (or the applicable legal age in your country), and they should not use them. You acknowledge and agree that the Portals and Services contain proprietary and confidential information protected by intellectual property and other applicable laws, and are the exclusive property of Unfold Your Best, its licensors, or our content providers. Unless otherwise indicated in writing, the Services are intended for your personal and non-commercial use. Regarding your use of the Portals and/or Services, you agree not to:

Copy, reverse engineer, disassemble, attempt to discover source code, distribute, transmit, display, perform, reproduce, publish, license, create derivative works, transfer, or sell any information, software, product, or service obtained through the Portals or Services;
Use any robot, search engine, "scraper," or other automated device to monitor, extract, collect, obtain, retrieve, or index any part of the Services;
Use any text, code, image, audio, or other content from any part of the Services (a) to create, analyze, or manipulate datasets (including activities designated as "data mining," "text and data mining," or "TDM") and/or (b) in connection with the development or operation of any software, including, among others, any artificial intelligence or machine learning model, software, or process (such as training, fine-tuning, embedding, and the like), directly or indirectly, including through third parties (e.g., using a third-party dataset created through prohibited means);
Access the Portals or Services by any means other than through industry-standard interfaces or those provided by Unfold Your Best;
Post or transmit any material containing viruses or corrupted data;
Remove any authorship attributions, legal notices, proprietary designations, or labels;
Violate any applicable local, state, national, or international law, statute, rule, or regulation, or use the Portals and/or Services for any purpose prohibited by this TOU;
Present or display the Portals and/or Services using frames or similar browsing technology;
Enroll, register, or unregister any person in any Unfold Your Best product or service without that person's express authorization;
Use the Portals or Services in a manner that damages, disables, overloads, or impairs Unfold Your Best's servers or networks or interferes with any other user's use of the Portals and/or Services;
Obtain or attempt to obtain unauthorized access to any portals, services, accounts, computer systems, or networks connected to Unfold Your Best through hacking, password mining, or any other means;
Obtain or attempt to obtain materials or information by any means not intentionally made available through the Portals or Services, or collect or obtain information about other users without their consent;
Use the Portals in a manner that harms, defames, or negatively impacts Unfold Your Best. Additionally, you agree to follow our Posting Guidelines below.

WITHOUT PREJUDICE TO THE FOREGOING, IT IS EXPRESSLY PROHIBITED TO COPY OR REPRODUCE ANY SERVICE, PROGRAMS, PRODUCTS, INFORMATION, OR MATERIALS PROVIDED BY UNFOLD YOUR BEST TO ANY OTHER SERVER OR LOCATION FOR SUBSEQUENT REPRODUCTION OR REDISTRIBUTION.

5. Discussion Forums, Chat Rooms, and Posting Rules.
Unfold Your Best hosts discussion forums, chat rooms, Tippi (a tool with health and wellness suggestions), and other public spaces on its Portals and through the Services. These spaces are intended to be discussion places for users and subscribers of the Portals. They are public, so any information you post may be seen by anyone on the Internet. You can edit or delete your own posts. When posting information, use common sense when discussing sensitive topics. Both users and moderators must treat others with respect and honesty. Be fair and informative. Post only honest and useful information, avoiding rumors or unfounded negative opinions. Unless the information comes directly from your personal experience, you should include references to medical or health information sources you mention.

In addition to the prohibited activities described previously, when posting information and multimedia content, you must not:

Post any content that interferes with or disrupts the operation of the Portals, including files containing malicious code, viruses, corrupted files, or any similar software/program that may damage the operation of computers, networks, or third-party portals;
Post statements or materials that are defamatory, libelous, harassing, abusive, persecutory, threatening, intimidating, or that violate the rights of third parties;
Post statements or materials that violate contractual or fiduciary duties;
Post or upload personal information, photos, videos, or other media of another person without their express authorization;
Delete or alter any material posted by another person or entity;
Post statements or materials that are biased, hateful, racially offensive, vulgar, obscene, pornographic, profane, or otherwise objectionable, including language or images that would be considered socially or professionally irresponsible or personally inappropriate;
Post statements or materials that incite criminal behavior, that may generate civil liability, or that violate any law or regulation of any jurisdiction;
Post statements or materials that may harm minors;
Impersonate another person or entity, real or fictitious, including employees and representatives of Unfold Your Best;
Misrepresent your affiliation with any entity and/or with Unfold Your Best;
Post any content that violates another person's privacy or image rights, including, without limitation, the disclosure of personally identifiable information such as addresses, phone numbers, email addresses, social security numbers, credit card numbers, or trade secrets or confidential information;
Post statements or materials that constitute "spam," unauthorized advertising, or promotional materials, including links to commercial products/services or political campaigns;
Post material that, in the sole discretion of Unfold Your Best, is considered objectionable, that restricts or prevents any person from using or enjoying interactive features of the Portals, or that may expose Unfold Your Best or its users to harm or liability; or
Post material that infringes, or may infringe, any patent, trademark, trade secret, copyright, or other intellectual property right of third parties, or that you do not have the right to make available without the rights holder's permission. Unfold Your Best has no obligation to provide indications as to whether material is protected by copyright or trademark. The user is solely responsible for any damages resulting from such infringement.

Failure to comply with these guidelines may result in expulsion and future denial of access to these public spaces. Unfold Your Best or its agents may remove or alter any user-generated content at any time and for any reason. Posted materials may be subject to size and usage limitations, and it is your responsibility to comply with them. Unfold Your Best and its licensors expressly disclaim any liability and endorsement, and make no statement regarding the validity of opinions, advice, information, or statements made by third parties in these forums, nor are they responsible for errors, omissions, or hyperlinks embedded in messages. Under no circumstances will they be liable for any loss or damage arising from your reliance on information obtained in these forums. The opinions expressed are solely those of the participants and do not reflect those of Unfold Your Best, its licensors, subsidiaries, or affiliates. We have no obligation to monitor content posted in these public spaces, but we reserve the right to do so at our sole discretion. Our moderators, who are generally not medical professionals, reserve the right to alter, edit, refuse, or remove any post, in whole or in part, for any reason, and to disclose materials to comply with the law or to protect us, our customers, sponsors, users, and visitors. Unfold Your Best and its moderators also reserve the right to contact users, hide posts, or delete accounts without prior notice, including for violation of this TOU.

By submitting or posting content, images, videos, audio files, creative suggestions, ideas, notes, concepts, information, or other materials (collectively, "Submitted Materials"), you grant us and our representatives a global, non-exclusive, sublicensable, transferable, royalty-free, perpetual, and irrevocable license to use, reproduce, distribute, modify, create derivative works, publicly display and perform, sell, offer for sale, and import such Submitted Materials in any current or future media, for any purpose, commercial or not, without compensation. You declare and warrant that any person depicted or referenced in those Submitted Materials has granted all necessary authorizations for such use. No Submitted Material in these public spaces will be subject to any duty of confidentiality.

6. Commercial Transactions.
Certain products or services may be available for purchase on the Portals or through the Services. If you wish to purchase or subscribe to any of them, Unfold Your Best or an authorized third party will ask you to provide information such as your full name, address, phone number, and credit card details. You commit to providing accurate, complete, and up-to-date information. You agree to comply with the terms of any purchase agreement. You are responsible for all charges on your account and for paying applicable taxes. By providing your credit card details, you authorize Unfold Your Best and/or its third-party service providers to immediately charge your account for all due fees and charges, including service or subscription fees. For services with recurring payments, you authorize automatic billing at the start of each period. We reserve the right to increase fees or institute new fees at any time, with reasonable prior notice (by email or mail). You must notify us immediately of changes to your billing address or credit card. You agree that we may take steps to collect amounts owed, and you are responsible for all costs associated with that collection, including court costs and attorneys' fees. 7. Third-Party Content.
Any opinions, advice, statements, services, advertisements, offers, or other content expressed or made available by third parties through the Portals are the responsibility of their respective authors or distributors, and not of Unfold Your Best. Neither Unfold Your Best, nor its licensors, nor third-party content providers guarantee the accuracy, completeness, or usefulness of such content. Furthermore, we do not endorse nor are we responsible for the accuracy or reliability of any opinion, advice, or statement made by anyone other than an authorized representative of Unfold Your Best or its licensor acting in their official capacity. You may be exposed to content that violates our policies, is sexually explicit, or offensive. Access to the Portals and Services is your responsibility. We are not responsible for exposure to third-party content. Unfold Your Best and its licensors have no obligation to obtain or include information beyond that provided by their third-party sources. We do not advocate the use of any product or procedure described, nor are we responsible for their misuse due to typographical errors.

8. Promotions, Contests, and Games.
If Unfold Your Best conducts any sweepstakes, contests, or games on the Portals, the applicable rules will be accessible via a highlighted hyperlink on the respective page. By participating, you agree to submit to those rules, regulations, and procedures. Review the rules carefully before participating.

9. Accounts, Passwords, and Security.
If any Portal or Service requires creating an account, you must complete the registration process by providing current, complete, and accurate information as requested. Providing false, inaccurate, outdated, or incomplete information grants Unfold Your Best the right to terminate your access and use of the Portals and/or Services. As part of registration, you will choose a username and a password. You are entirely responsible for the security and confidentiality of your account and password, as well as for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account or other security breach. Neither Unfold Your Best nor its licensors will be liable for losses resulting from the use of your account or password by another person, with or without your knowledge. You may be held liable for losses suffered by Unfold Your Best, its licensors, or third parties due to such use.

10. Linking to Our Portals.
We reserve the right, at our sole discretion, to prohibit the creation of links to our Portals. If we do so, you agree to immediately remove and disable all such links. In the absence of a written agreement specifying how you may create links, use the following guidelines to add a link from your website:

The link must be text-only and clearly include the URL of the portal in question;
If the link points to a page other than the home page, the text must include the title of the destination page (e.g., "Healthy Living - Unfold Your Best");
The appearance, position, and other aspects of the link must not harm or dilute the reputation associated with our name and brands;
The appearance, position, and other aspects of the link must not create the false impression that an entity is associated, sponsored, or endorsed by us;
The link, when activated, must display the Portal in full screen and not within a frame of the originating site, and must not trigger interstitial, pop-up, or pop-under windows; and
The link cannot be used on, nor appear on, a website that a reasonable person would consider offensive, obscene, defamatory, or malicious.

11. Notice Regarding Links to Third-Party Portals.
We reserve the right to change, modify, add, or remove parts of this TOU at any time, without prior notice, with changes taking effect immediately upon posting, unless otherwise indicated. Continued use of the Portals or Services after such changes constitutes acceptance of the new terms. We recommend that you bookmark this page and review this TOU regularly.

12. Interactions with Third Parties.
Any participation, correspondence, or commercial transaction with third parties (such as advertisers or other users) found on or through our Portals and Services, including payment and delivery of goods or services, is solely between you and that third party. You agree that Unfold Your Best will not be liable for any losses, damages, or other issues arising from such interactions.

13. Data Protection.
Unfold Your Best's privacy policy regarding the collection and use of your personal information is available at //www.unfoldyourbest.com/privacy-policy.aspx and is incorporated by reference into this Terms of Use. BY ACCESSING THE PORTALS AND/OR SERVICES, YOU AGREE TO ACCEPT OUR PRIVACY POLICY.

14. Disclaimer of Warranties.
THE PORTALS AND SERVICES, AS WELL AS ANY CONTENT, TOOL, PRODUCT, OR SERVICE MADE AVAILABLE THEREIN, ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, UNFOLD YOUR BEST, ITS LICENSORS, AFFILIATES, SUPPLIERS, AND AGENTS DO NOT WARRANT AND DISCLAIM: (i) THAT YOUR USE OF THE PORTALS AND/OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (ii) THAT ANY INFORMATION OBTAINED WILL BE ACCURATE, RELIABLE, OR COMPLETE; (iii) THAT ANY DEFECTS WILL BE CORRECTED; OR (iv) THAT ANY SOFTWARE, SERVICE, PORTAL, OR SERVER(S) HOSTING THEM ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE USE OF THE PORTALS, SERVICES, AND ANY INFORMATION OR MATERIAL MADE AVAILABLE THEREIN IS AT YOUR SOLE RISK. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE PRODUCTS OR SERVICES SOLD OR ADVERTISED, OR COMPLIANCE WITH DRUG DISCLOSURE REGULATIONS. WE MAKE NO REPRESENTATION OR WARRANTY REGARDING TREATMENTS, DRUG ACTION, OR INFORMATION OFFERED.

15. Limitation of Liability.
Neither Unfold Your Best, nor its licensors, directors, employees, contractors, agents, or sponsors will be liable to you or any other person for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, under any theory of liability (contractual, tort, strict), arising from or related to: (i) the use or inability to use the Portals and/or Services; (ii) any content contained in the Portals and/or Services; (iii) statements or conduct made public on the Portals and/or Services; (iv) ANY PRODUCT OR SERVICE ACQUIRED THROUGH THE PORTALS AND/OR SERVICES; (v) ANY ACTION TAKEN IN RESPONSE TO INFORMATION MADE AVAILABLE THEREIN; (vi) ANY DAMAGE DUE TO LOSS OF ACCESS, DELETION, STORAGE FAILURE, BACKUP FAILURE, OR ALTERATION OF CONTENT; OR (vii) ANY OTHER RELATED MATTER. IN NO CIRCUMSTANCES WILL THE AGGREGATE LIABILITY OF UNFOLD YOUR BEST OR ITS LICENSORS EXCEED THE AMOUNT PAID BY YOU (IF ANY) FOR THE USE OF THE PORTALS AND/OR SERVICES. Some jurisdictions do not allow exclusions of warranties or limitations of liability, so some of the above limitations may not apply. To the maximum extent permitted by law, the scope and duration of any implied warranty and the extent of our liability will be the minimum required by applicable law.

16. Indemnification Commitment.
You agree to indemnify, defend, and hold harmless Unfold Your Best and its licensors, subsidiaries, affiliates, directors, agents, partners, employees, and representatives from any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising directly or indirectly from: (i) your violation of this TOU; (ii) claims that your Submitted Materials infringe third-party intellectual property rights; and (iii) your access or use of the Portals or Services.

17. Copyright Policy.
Global Copyright Laws provide recourse to rights holders who believe that material published online infringes their rights under the law of their Country. If you believe in good faith that material hosted by Unfold Your Best infringes your rights, you or your representative may send a notification requesting removal or blocking of access. Non-compliant notifications will not be considered valid. If you believe a notification has been improperly filed against you, you may send a counter-notification. All notifications must comply with legal requirements (see the Copyright Law of your Country). To report an infringement, provide us with:

Electronic or physical signature of the person authorized to act on behalf of the rights holder;
Identification of the allegedly infringed protected work;
Sufficient identification of the allegedly infringing material to allow its location;
Contact information (address, phone, email);
A statement that you believe in good faith that the use is not authorized; and
A statement, under penalty of perjury, that the information in the notification is accurate and that you are the rights holder or authorized to act on their behalf.

18. Jurisdiction Issues.
Unfold Your Best does not guarantee that the content of the Portals or Services is appropriate or available outside Brazil. Those accessing from other locations do so at their own initiative and risk, and are responsible for compliance with applicable local laws. Unfold Your Best reserves the right to limit the availability of the Portals or Services to any person, geographic area, or jurisdiction and to limit the quantities of services or products offered.

19. Termination of the Agreement.
Unfold Your Best may, at its sole discretion, terminate your password, account, or use of the Portals or Services and remove or discard any content, at any time and for any reason. You agree that such action may be taken without prior notice.
